1. Introduction
Welcome to Zukarte, the official online marketplace platform of Zukarte Private Limited, a company incorporated under the Companies Act, 2013 with CIN U72900KL2021PTC069500, having its registered office at 6/858-M, 2nd Floor, Suite 198, Valamkottil Towers, Judgemukku, Thrikkara PO, Kakkanad, Kochi, Ernakulam, Kerala, India, 682021.
These Terms and Conditions ("Terms") outline the rules and guidelines for using the Zukarte mobile application and website (collectively referred to as the “Platform”). By accessing or using Zukarte, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should refrain from using the Platform.
Zukarte provides a digital space for individuals and businesses to list, discover, and engage in buying and selling a variety of products across 26 different categories. The following key features are available as part of our initial release:
- ZPoints – a rewards system where users can earn and spend points within the platform.
- Make Deal – an option that allows buyers and sellers to negotiate prices.
- Zukarte Shield – a secure transaction feature that protects buyers using Zukarte’s payment interface.
- In-Person Payments – enables direct payment to the seller in person as per mutual agreements.
- Chats – facilitates secure, real-time communication between users.
- Ad Banners – Ad placeholder for Zukarte users or external advertisers for promotional or commercial advertisements.
Zukarte's listing policy during the launch phase is designed to be user-friendly and flexible:
- Each user is provided with 30 free listings by default
- Additional listings may be automatically granted based on platform activity
- There are no category-specific limitations on listings during this initial phase
These Terms apply to all users of the Platform, including buyers sellers and advertisers. We encourage you to review them carefully. Updates to these Terms may be made from time to time, and continued use of the Platform indicates acceptance of any changes.

2. Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meanings set forth below. These definitions apply whether the terms are used in singular or plural form.
“Zukarte” refers to the online marketplace platform operated by Zukarte Private Limited, including its website, mobile application, and associated services.
“User” means any individual or legal entity who accesses or uses the Platform, including Buyers, Sellers, and Advertisers.
“Buyer” refers to a User who browses, negotiates, or purchases products listed on the Platform.
“Seller” refers to a User who lists items or services for sale on the Platform, either as an individual or business entity.
“Advertiser” means any User or third party using designated spaces on the Platform to display promotional or commercial advertisements.
“Listing” refers to any item, product, or service posted for sale on the Platform by a Seller.
“ZPoints” refers to the in-app reward points system that allows Users to earn, redeem, or spend points on eligible actions and promotions within the Platform.
“Make Deal” refers to the feature that enables Buyers to make a price offer on a listed item and allows Sellers to accept, decline, or counter the offer.
“Zukarte Shield” or “Shield” is the payment protection feature where funds are held securely by Zukarte and only released to the Seller after the Buyer confirms satisfactory receipt of the item.
“In-Person Payment” refers to the offline payment option where the Buyer pays the Seller directly at the time of physical item handover, bypassing Zukarte’s payment system.
“Chat” refers to the in-app communication tool that allows Users to message each other securely regarding items, negotiations, and transactions.
“Spark” refers to a badge shown on listings or Seller profiles that have been promoted using ZPoints or other promotional tools, indicating increased visibility.
“Item Condition” defines the physical state of a listed item, as chosen by the Seller. The available conditions are:
- New – Unused and in original packaging.
- Like New – Barely used and in excellent condition.
- Well Used – Clearly used but still functional.
- Used – Shows signs of use but in good working condition.
“Listing Status” refers to the current availability or administrative state of a listing. Statuses include:
- Active – Visible and available for purchase.
- Sold Out – Item has been sold and is no longer available.
- Reserved – Temporarily held.
- Pending – Awaiting admin review or approval before going live.
“Platform” collectively refers to the Zukarte mobile application, website, and any associated digital services or tools provided by Zukarte Private Limited.
“Account” means the personal profile and login credentials associated with a User on the Platform.
3. Eligibility
To access and use the Zukarte Platform, users must meet the following eligibility criteria and usage conditions:
3.1 Minimum Age
You must be at least 18 years of age to register for and use the Zukarte Platform. By creating an account, you represent and warrant that you are legally competent to enter into binding agreements under applicable law. If you are under 18, you may only use the Platform under the supervision of a parent or legal guardian, who agrees to be bound by these Terms.
3.2 Guest Access
Zukarte allows non-registered users (guests) to browse the Platform, search listings, and view public product information. However, to perform any interactions including but not limited to making purchases, sending messages or chat, posting listings, liking or pinning items, following profiles, making offers through “Make Deal,” or accessing personal features such as the ZPoints Wallet you must sign in with a valid Zukarte account.
3.3 Jurisdiction and Legal Compliance
The Platform is currently intended for users residing in India. You confirm that your use of the Platform does not violate any applicable laws or regulations. Access from countries or jurisdictions where such services are restricted is prohibited.
3.4 Business Use
If you are creating or managing an account on behalf of a business, shop, or organization, you must be duly authorized to act on its behalf. Business users must ensure compliance with all relevant laws and taxation requirements, including Goods and Services Tax (GST) registration and other applicable regulations in India.
3.5 Right to Refuse or Terminate Access
Zukarte reserves the right to restrict, suspend, or terminate access to the Platform at its sole discretion if any eligibility conditions are found to be violated or if your activity is deemed unlawful, inappropriate, or harmful to the community.
4. User Account & Responsibilities
To access and utilize core features of the Zukarte Platform such as listing items, making purchases, engaging in chats, using ZPoints, or interacting with other users you are required to create a Zukarte user account. This section outlines your responsibilities in managing and securing your account.
4.1 Registration Process
Zukarte provides a simple, intuitive, and secure registration process for both individual users and businesses.
- To sign up, users must enter a valid mobile number (mandatory) and optionally, their first name.
- Upon submission, users will be directed to an OTP (One-Time Password) screen to complete the mobile number verification.
- Alternate sign-up options include Google, Facebook, and Apple authentication under the "Or Continue with" section.
- After successful registration, users are encouraged to personalize their experience by selecting 5–8 favourite categories from the available list.
- Users signing up as businesses can enter their GSTN and PAN details within their profile settings. Zukarte automatically classifies such users as business users based on this information.
For returning users, login can be completed via mobile number, email address, or username. Depending on the login method:
- OTP verification will be prompted for mobile numbers and email logins.
- Password entry will be required for username-based login.
- Social login will authenticate directly through the chosen platform.
4.2 Accurate and Updated Information
You agree to provide accurate, truthful, and up-to-date information during registration and throughout your use of the Platform. Any attempt to impersonate, falsify identity, or mislead other users or the platform through inaccurate profile, listing, or business data may result in account suspension or termination.
4.3 Responsibility for Account Activity
As a Zukarte user, you are solely responsible for all actions performed through your account. This includes, but is not limited to:
- Messages, listings, purchases, offers, and reviews.
- Transactions performed using your credentials.
You must ensure that your account is used only by you or by individuals authorized by you. If you're operating on behalf of a business, you confirm that you have the legal authority to represent and act for that business.
4.4 Account Security and Multiple Devices
You are responsible for safeguarding your login credentials. Zukarte allows access from multiple devices, but any suspicious activity (such as simultaneous logins from different locations) may prompt additional verification or lead to temporary account restrictions.
You must not share your password or OTP with anyone. If you suspect any unauthorized access to your account, you should immediately notify us at support@zukarte.com.
Zukarte is not liable for any loss arising from compromised credentials or failure to secure your account.
4.5 Account Deactivation and Deletion
Users who wish to delete their account can initiate the process through the Zukarte app or website.
- The system will send a deactivation link to the user's registered email address.
- If no email is yet associated with the account, the system will first prompt for email verification.
- Upon clicking the deactivation link, the account enters a 21-day deactivation period during which the account remains inactive.
- If the user does not log in again within those 21 days, the account will be permanently deleted, along with all associated data and listings.
- Users may reactivate their account at any point during the deactivation window by logging in again.
5. General Use of Zukarte
By accessing or using the Zukarte Platform, you agree to adhere to the following rules and standards, designed to ensure a safe, respectful, and lawful environment for all users.
5.1 Permitted Use
You are permitted to use Zukarte to:
- Browse and search listings without creating an account.
- List, buy, or sell items across the Platform’s supported categories after signing in.
- Interact with other users via secure, in-app messaging.
- Earn and redeem ZPoints through eligible actions and promotions.
- Access features such as Zukarte Shield, Spark (for promoted listings), and community tools.
5.2 Prohibited Use
The following uses are strictly prohibited:
- Engaging in any activity that violates local, national, or international laws or regulations.
- Uploading or sharing content that is offensive, obscene, defamatory, misleading, fraudulent, threatening, hateful, or otherwise inappropriate.
- Selling illegal, counterfeit, restricted, or dangerous goods.
- Impersonating another person or entity, or misrepresenting your affiliation with any party.
- Engaging in unauthorized advertising, phishing, or unsolicited communications (spam).
- Tampering with or circumventing Platform security, moderation, or verification mechanisms.
- Mining, scraping, or harvesting data from Zukarte without prior authorization.
Accounts found in violation may be restricted, suspended, or permanently removed.
5.3 Community Behaviour Expectations
We expect all users to foster a positive and inclusive environment. This includes:
- Treating fellow users with courtesy, respect, and fairness.
- Using appropriate language and refraining from discriminatory or harmful remarks.
- Cooperating with other users in a trustworthy and honest manner during transactions.
- Reporting harmful content, fraud, or misconduct promptly using available in-app tools.
Abuse, hate speech, harassment, or exploitation of any kind will result in disciplinary action.
5.4 Posting and Listing Rules
When listing items or posting content, users must ensure:
- All information is accurate, including item condition, price, and availability.
- Items are categorized correctly and use appropriate titles, descriptions, and images.
- Duplicate listings are avoided unless reposted in compliance with platform rules.
- Only items or services owned or legally authorized by the user are listed.
Accepted Item Conditions (must be clearly stated in listings):
- New
- Used
- Well Used
- Likely New
Listing Status Options (must be updated promptly by the seller):
- Available
- Reserved
- Sold Out
- Pending (e.g., awaiting admin review)
5.5 No Offensive or Illegal Content
Zukarte strictly prohibits:
- Content promoting or depicting illegal activity, violence, or harm.
- Nudity, pornography, sexually explicit content, or hate symbols.
- Content that infringes on copyright, trademarks, or other intellectual property.
- Misleading, false, or manipulated listings meant to deceive or harm users.
Any content that violates these rules will be removed, and the responsible account may be suspended or banned.
5.6 Moderation and Platform Oversight
Zukarte actively monitors platform activity to maintain quality and safety. We reserve the right to:
- Edit, suspend, or remove content that violates our policies or is reported by users.
- Review flagged listings, messages, reviews, or profiles.
- Take enforcement actions, including warnings, account suspension, or bans, at our sole discretion.
Some listings may be temporarily marked as Pending while under review by our moderation team.
5.7 Appeals and Review Process
If your content or account has been removed, restricted, or flagged:
- You will typically receive a notification explaining the action taken.
- You may request a review of the decision through the in-app support channel or by contacting support@zukarte.com.
- Zukarte will review appeals on a case-by-case basis and notify users of the outcome.
Please note that repeat violations may result in permanent removal without the right to appeal.
5.8 Third-Party Content Responsibility
While Zukarte enables peer-to-peer transactions and content sharing, we do not endorse, guarantee, or assume responsibility for:
- The accuracy, reliability, or legality of user-generated content or listings.
- The quality or condition of any item sold or offered on the platform.
- Interactions or agreements made between users, outside of features we facilitate (e.g., Zukarte Shield).
Users engage with each other at their own discretion and are responsible for exercising appropriate judgment and caution.
6. ZPoints Terms
ZPoints are the official digital reward points used within the Zukarte platform to promote user engagement, enhance visibility, and unlock added features. Users may earn, purchase, and redeem ZPoints under the following terms and conditions.
6.1 Earning ZPoints
Zukarte users can earn ZPoints through various in-app activities and platform engagements, including:
- Listing items for sale (during promotional periods or specific campaigns).
- Completing successful transactions and marking appropriate status updates (e.g., "Delivered", "Received").
- Adding ratings and reviews for completed purchases.
- Verifying their user account (mobile number, email, and other identity confirmations).
- Referring friends to Zukarte (when part of a referral campaign).
- Participating in promotional challenges or platform engagement drives.
ZPoints earned may vary depending on the activity, campaign type, user role, or time of interaction. Zukarte reserves the right to update or discontinue specific point-earning criteria at any time.
6.2 Purchasing ZPoints
In addition to earning, users can also purchase ZPoints directly through the platform. The ZPoints section within the My Profile page provides:
- Predefined ZPoint packs for quick selection (e.g., 100, 500, 1000 ZPoints).
- Custom ZPoint purchases, where users can specify the amount they want to purchase (subject to platform-defined limits).
All purchases are subject to applicable taxes and payment processing charges. Purchased ZPoints will be credited instantly upon successful payment confirmation.
6.3 Redemption and Use of ZPoints
ZPoints can be redeemed for a variety of purposes within Zukarte, including:
- Profile Promotion and Item Promotion (both display the Spark badge).
- Purchasing additional listing quotas once the free limit is exhausted.
- Unlocking special features or premium services as introduced in future releases.
ZPoints:
- Cannot be exchanged for cash or withdrawn.
- Cannot be transferred between users.
- Can only be used within the Zukarte ecosystem.
6.4 Expiry and Validity
- ZPoints are valid for 12 months from the date of earning or purchase, unless otherwise stated.
- Users will be notified in advance before their ZPoints expire, through email or in-app alerts.
- Expired ZPoints will be automatically removed from the user’s account and cannot be restored.
Zukarte is not responsible for expired or unused ZPoints beyond the stated validity period.
6.5 Fraud Prevention and Misuse
To maintain the integrity of the ZPoints system:
- Users must not use bots, fake accounts, or exploit platform vulnerabilities to earn or redeem points.
- Self-reviews, fake transactions, or referral manipulation to earn ZPoints is strictly prohibited.
- Zukarte reserves the right to suspend or revoke ZPoints in case of fraudulent behaviour or abuse of the reward system.
- Repeat offenders may face account suspension or permanent ban.
6.6 Zukarte Rights and Modifications
Zukarte reserves the right to:
- Modify or discontinue the ZPoints program at any time.
- Change the earning and redemption structure, including rates, eligibility, and rules.
- Limit redemption options based on user history, technical constraints, or business policies.
- Introduce seasonal offers, bonus points, or limited-time features tied to ZPoints.
Users are encouraged to regularly check the ZPoints section in their profile for the latest updates.
7. Buying & Selling Terms
Zukarte facilitates a dynamic marketplace connecting buyers and sellers. To ensure a secure and transparent environment, all users engaging in transactions must adhere to the following terms
7.1 Listing Rules
- Accuracy: Sellers must provide truthful and comprehensive descriptions of their items, including condition, specifications, quantity, and authenticity.
- Prohibited Items: Listings must not include items that are illegal or violate Zukarte's Prohibited Item Policy.
- Content Guidelines: All listings should comply with Zukarte's content standards, ensuring appropriateness and relevance.
7.2 Product Accuracy and Truthfulness
- Honest Representation: Sellers are responsible for the accuracy of their listings. Misleading or deceptive descriptions may result in listing removal or account suspension.
- Image Authenticity: Photos uploaded must represent the actual item being sold and should not be stock images unless clearly stated.
7.3 Pricing and Offers
- Setting Prices: Sellers determine the initial listing price.
- Negotiation: Buyers can:
- Use the Make Deal feature to accept the listed price or propose a new one.
- Initiate communication with sellers via the Chat function to discuss terms.
- Offer Responses: Sellers may accept or decline offers. An accepted offer changes the item's status to Reserved, preventing further offers. Declined offers will notify buyers accordingly.
7.4 Seller Obligations
- Inventory Management: Sellers must ensure that listed items are available and update their status promptly.
- Timely Fulfilment: Upon accepting an offer, sellers should coordinate with buyers for prompt delivery or pickup.
- Status Updates: Sellers are required to update the transaction status using options like Delivery in Progress and Item Delivered to keep buyers informed.
- Relisting: If a buyer fails to complete the purchase within the agreed timeframe, sellers may relist the item.
7.5 Buyer Responsibilities
- Prompt Communication: Buyers should respond swiftly to seller messages and confirm transaction details.
- Completion of Purchase: Buyers are expected to complete the purchase within the agreed timeframe and adhere to the seller's terms.
- Transaction Confirmation: After receiving the item, buyers must confirm receipt by selecting Item Received. If the item is not received within 15 days, buyers can select Item Not Received Yet to extend the confirmation period by 6 additional days.
- Reviews: Providing honest feedback upon transaction completion helps maintain marketplace integrity.
7.6 Zukarte Shield Listings
For enhanced security, certain items are designated as Shield Listings, identifiable by a Shield badge.
- Direct Purchase: Buyers can use the Buy button to purchase Shield-listed items directly.
- Cart Functionality: Items can be added to the cart for batch purchases.
- Checkout Process: Buyers will:
- Select item variants and quantities.
- Provide or confirm delivery details.
- Choose delivery methods and request invoices if needed.
- Complete payment through secure gateways.
- Order Tracking: Sellers must update the order status, and buyers can track progress through their accounts.
- Dispute Resolution: In case of issues, buyers can request refunds, which Zukarte will process per its refund policy.
7.7 Transaction Workflow
Zukarte has established a structured workflow to ensure smooth transactions:
- Initiating Transactions: Buyers express interest through Make Deal or Chat functions.
- Offer Management: Sellers respond to offers, leading to item reservation upon acceptance.
- Status Updates: Sellers and buyers update transaction statuses to reflect progress, ensuring transparency.
- Completion and Feedback: Transactions conclude with delivery confirmation and mutual feedback, rewarding both parties with ZPoints.
8. Payment Terms
At Zukarte, we are committed to providing a seamless and secure payment experience for our users. This section outlines the terms related to payments, including supported methods, refund and dispute mechanisms, and our payment protection feature.
8.1 Supported Payment Methods
Zukarte utilizes Razorpay as our payment gateway, supporting a variety of payment methods to accommodate user preferences:
- Credit and Debit Cards: All major domestic and international credit and debit cards are accepted.
- Net banking: Access to over 50 net banking options from leading banks.
- UPI (Unified Payments Interface): Facilitates instant payments through UPI-enabled apps.
- Digital Wallets: Payments can be made using popular wallets.
- EMI (Equated Monthly Instalments): Available for eligible credit cards, allowing payments to be made in instalments.
8.2 Refund and Dispute Mechanism
Zukarte is committed to ensuring fair resolutions in case of disputes:
- Refund Eligibility: To qualify for a refund, buyers must demonstrate that the received item significantly deviates from the listing description. Conversely, sellers must provide evidence that the item was shipped as described.
- Refunds: Users can initiate refund requests through the Zukarte platform. Once a refund is processed, it cannot be cancelled or reversed.
- Disputes: If a transaction is disputed, users will receive an email notification. To contest a dispute, users can submit evidence through the Zukarte platform.
- Evidence Submission: Both parties can submit supporting materials, such as video recordings or photographs, to substantiate their claims.
- Intermediary Role: Zukarte acts as an impartial intermediary, assessing the provided evidence and facilitating a fair resolution based on the merits of the case.
8.3 Payment Protection (Shield Feature)
The Shield feature offers enhanced payment security:
- Secure Transactions: Payments for Shield-listed items are held securely until the buyer confirms receipt and satisfaction with the purchase.
- Dispute Handling: In the event of a dispute, funds are retained until a resolution is reached, ensuring protection for both parties.
9. Item Promotion Policy
Zukarte provides sellers with promotional tools aimed at increasing the visibility and reach of their listings and profiles. These tools are designed to support sellers in enhancing engagement and driving potential sales through strategic item and profile promotion.
9.1 Purpose of Promotion
Promotional features such as Spark and Profile Promotion enable sellers to:
- Increase the visibility of selected listings or their entire profile.
- Leverage marketing opportunities during special campaigns, seasonal events, or new launches.
- Reach more users and improve chances of generating sales.
9.2 Access to Promotion Features
Sellers can access promotional options through:
- The "Promote" button on each item listing.
- The "Promote Profile" option under the My Profile > Listings section.
Upon selection, sellers are redirected to the promotion interface displaying item details, available promotion types, and current ZPoints balance.
9.3 Spark Promotion
Spark is a listing-based promotion that refreshes and prioritizes the visibility of a specific item for a set duration.
- Minimum Duration: One week.
- Zpoints Deduction: Required Zpoints will be deducted upon activation; the amount is subject to Zukarte’s administrative policy.
- Badge: Promoted items display a "Spark" badge for identification.
- Scheduling Option: Spark can be scheduled to start at a future date chosen by the seller.
9.4 Profile Promotion
Profile Promotion increases the visibility of all listings under a seller’s profile.
- Minimum Duration: One week.
- ZPoints Deduction:
- A base ZPoints amount applies for a specified number of listings.
- Additional listings may incur further ZPoints charges.
- A weekly cap may be applied to limit maximum ZPoints usage.
- Charges and Caps: All promotion charges, base limits, and caps are determined and may be revised by Zukarte administration without prior notice.
- Activation: Initiated through the seller’s profile with automatic ZPoints deduction. Sellers with insufficient ZPoints will be prompted to purchase more.
9.5 General Terms
- All promotion fees and conditions are subject to change at Zukarte’s sole discretion.
- Promotions are non-refundable once activated.
- Promotion periods are fixed and cannot be paused or altered after initiation.
- Promotional visibility is influenced by Zukarte’s recommendation algorithms, platform behaviour, and marketplace trends.
- Any misuse or manipulation of promotional tools may result in restriction, suspension, or termination of promotion privileges.
9.6 Promotion Benefits
- Boosted Visibility: Promoted listings and profiles are shown more prominently to potential buyers.
- Increased Engagement: Enhanced reach leads to more views, inquiries, and potential conversions.
- Scalable Promotion: Ideal for sellers with multiple listings due to structured and capped pricing policies.
- Marketing Support: Especially beneficial for promotional events, product rollouts, or stock clearance efforts.
11. Intellectual Property
11.1 Ownership of Zukarte Branding and Content
All content made available on the Zukarte platform, including but not limited to text, graphics, logos, icons, images, audio clips, videos, digital downloads, data compilations, and software, is the exclusive property of Zukarte Pvt Ltd or its content suppliers and is protected under applicable copyright, trademark, and other intellectual property laws.
The Zukarte name, logo, platform design, interface elements, and all related branding elements are trademarks and intellectual property solely owned by Zukarte Pvt Ltd. You may not use, reproduce, distribute, modify, or create derivative works from any part of the Zukarte branding or content without prior written consent from Zukarte Pvt Ltd.
11.2 User-Generated Content Rights
Zukarte allows users to post, upload, or share content such as product listings, descriptions, images, reviews, comments, or other materials ("User-Generated Content") on the platform. By submitting such content, you grant Zukarte Pvt Ltd a worldwide, non-exclusive, royalty-free, transferable, and sub-licensable license to use, reproduce, display, modify, adapt, publish, translate, and distribute such content in connection with the operation, promotion, and improvement of the platform and its services.
You retain ownership of your content but represent and warrant that you have the legal right to post it and that it does not infringe the rights of any third party, including intellectual property rights. Zukarte reserves the right to remove or restrict access to any content that violates our policies, applicable laws, or the rights of others.
11.3 Trademark and Copyright Protection
All trademarks, service marks, logos, and trade names appearing on the platform are the property of Zukarte Pvt Ltd or their respective owners. No license or right is granted to you to use any trademark displayed on the platform without the prior written permission of the respective trademark owner.
The software, source code, and technology underlying the platform are protected by copyright and other intellectual property laws. You are prohibited from copying, modifying, reverse engineering, decompiling, or disassembling any part of the Zukarte platform or services. Any unauthorized use of Zukarte’s intellectual property may result in legal action, including claims for damages and injunctive relief.
12. Termination & Suspension
12.1 Grounds for Suspension or Banning
Zukarte Pvt Ltd reserves the right to suspend, restrict, or permanently terminate your access to the platform or any part of its services without prior notice if, in our reasonable opinion, you:
- Violate these Terms & Conditions, Privacy Policy, or any applicable laws or regulations;
- Engage in fraudulent, abusive, misleading, or harmful behaviour;
- Post or share content that infringes on the rights of others or is otherwise inappropriate;
- Attempt to interfere with the proper functioning of the platform, including unauthorized access to accounts, data, or systems;
- Repeatedly receive negative reviews or user reports that indicate a pattern of misconduct.
We may take these actions at our sole discretion to protect our users, community, and business interests.
12.2 Effects of Termination on ZPoints, Wallet, etc.
If your account is suspended or terminated:
- Any remaining ZPoints associated with your account may be forfeited at the discretion of Zukarte, especially if the termination results from policy violations or fraudulent activities.
- In future platform updates where a Wallet feature is available, any remaining wallet balance may be subject to review, withholding, or forfeiture based on the reason for termination and applicable legal or regulatory requirements.
- You will no longer be able to access your listings, saved data, communication history, or collaboration records.
- Zukarte may retain your data for audit, legal, and platform integrity purposes, as detailed in our Privacy Policy.
Users may request clarification or appeal certain suspension or termination actions by contacting our Support team. However, Zukarte retains full discretion in all final decisions.
13. Limitation of Liability
13.1 Scope of Zukarte’s Responsibility
While Zukarte strives to provide a reliable, secure, and seamless user experience, we do not guarantee that the platform will always function without interruption, delay, or error. By using Zukarte, you acknowledge and agree that:
- The platform is provided on an “as is” and “as available” basis.
- Zukarte Pvt Ltd makes no warranties, express or implied, regarding the accuracy, reliability, suitability, or availability of the platform or any information, products, or services provided through it.
- Zukarte does not guarantee the performance, quality, safety, or legality of items listed or sold on the platform, or the conduct of any user.
13.2 Service Downtime and Technical Issues
Zukarte is not liable for:
- Any temporary unavailability, delays, or system errors caused by maintenance, technical failures, or factors beyond our control (such as internet outages or third-party disruptions).
- Any data loss, system corruption, or unauthorized access resulting from user negligence or external attacks.
We will, however, make reasonable efforts to notify users in advance of any planned downtime and to restore services as promptly as possible.
13.3 Limit on Financial Liability
To the fullest extent permitted by applicable law:
- Zukarte’s total liability for any claims arising out of or relating to the use of our platform shall not exceed the total amount (if any) paid by the user to Zukarte in the six (6) months preceding the event that gave rise to the liability.
- Zukarte shall not be liable for any indirect, incidental, punitive, special, or consequential damages, including but not limited to lost profits, lost data, or loss of goodwill, even if advised of the possibility of such damages.
This limitation applies regardless of the nature of the claim whether in contract, tort, negligence, or otherwise.
14. Dispute Resolution
14.1 Resolution through Platform Support
In the event of any dispute, issue, or complaint arising between users or between a user and Zukarte, we encourage resolution through the platform’s in-app communication and support channels as the first course of action. Zukarte provides the following mechanisms to facilitate resolution:
- In-app chat and transaction logs to clarify and resolve order-related concerns.
- A dedicated Customer Support & Escalation system accessible through the “Support” section of the platform.
- Step-by-step resolution assistance by Zukarte’s support team, which may include mediation between parties, if applicable.
Users are expected to cooperate fully and in good faith during the resolution process. Zukarte reserves the right to intervene in cases where platform policies or safety are involved.
14.2 Jurisdiction and Legal Proceedings
If a dispute cannot be resolved through the platform or customer support escalation and requires legal recourse, the following terms apply:
- All legal disputes or claims related to the use of Zukarte’s services shall be governed by the laws of India.
- Ernakulam District court, location: Kochi, Kerala, shall have exclusive jurisdiction over any such matters.
- You agree to submit to the personal jurisdiction of the courts in Kochi, Kerala, for the purpose of litigating any such dispute.
